Jennifer Hudson asks public to help find nephew, 7

CHICAGO – Oscar-winning actress Jennifer Hudson appealed on Sunday for the public's help in finding her 7-year-old nephew, missing since the shooting deaths of her mother and brother.
City police transferred custody of the man labeled a "person of interest" in the shooting deaths to state authorities.
An Amber Alert remained in effect Sunday for young Julian King, who disappeared on Friday, the day the bodies of his grandmother, Darnell Donerson, 57, and 29-year-old uncle Jason Hudson were found in the home they all shared on the city's South Side. The deaths were ruled homicides.
The Amber Alert listed William Balfour, the estranged husband of Jennifer Hudson's sister, Julia Hudson, as a suspect in a "double homicide investigation." Julia Hudson is the missing boy's mother
Chicago police spokeswoman Monique Bond said authorities considered Balfour a "person of interest" in the case but he had not been charged.
Authorities said the search for Julian would be citywide, but on Sunday residents and officers focused their efforts "in the immediate vicinity" of the family's home in the Englewood section, said police spokesman Dan O'Brien.
Police said they did not have a motive for the killings but called the case "domestic related."
"There's a lot of forensic evidence. We have to work the evidence and try and solve this case," Bond said Sunday. "Most importantly, we want to find the child." READ

Court issues stay, lets Davis make his case

The federal appeals court in Atlanta on Friday halted Troy Anthony Davis’ execution, the third time his life has been spared shortly before he was to be put to death.

Davis’ claims of innocence, based largely on the recantations of prosecution witnesses, have attracted international attention and protest. He was set to be executed by lethal injection Monday evening for the 1989 murder of an off-duty Savannah police officer.

The 11th Circuit’s ruling is the latest in what has been a roller-coaster ride of last-ditch appeals in which Davis, 40, has been repeatedly denied relief only to be spared again and again.

Martina Correia, Davis’ sister, said she and her mother, Virginia Davis, were packing for the trip to death row when they got the news.

“I’ve been praying,” Correia said. “He deserves to be free. He at least doesn’t deserve to die for something he didn’t do.”

Since Davis’ 1991 trial, seven of nine key prosecution witnesses have backed off their testimony. Others have come forward and implicated another man in the killing of 27-year-old Savannah Police Officer Mark Allen MacPhail.

The witnesses’ recantations have prompted leaders across the globe to call for Davis’ death sentence to be commuted. But Chatham County prosecutors say they are certain Davis is a cop killer and deserves to die for the crime.

When the 11th Circuit issued its stay, Davis’ supporters were holding a mock funeral at the state Capitol. Demonstrators carried a coffin and a petition with 140,000 signatures to the state Board of Pardons and Paroles. Davis’ supporters also delivered a letter signed by more than 100 members of Georgia’s clergy to the governor’s office.

Correia talked to Davis after the court issued its stay. “To all the people around the world working hard and fighting for him, he wants to say thank you and this fight has to continue,” she said.

The slain officer’s 75-year-old mother, Anneliese MacPhail, expressed fury and exasperation.

“It’s unbelievable,” she said. “It’s tearing us apart. I’m at the end with my nerves. I can’t sleep, I can’t eat. This is ridiculous.”

Mark Allen MacPhail’s sister, Kathy McQuary, cried when she learned of the stay from a reporter.

Davis’ lawyers expressed hope the stay leads to the new evidence being presented.

“I am extremely relieved that the 11th Circuit, when addressed with such a grave issue as the innocence of a man set for execution, wants to hear argument and make a considered judgment,” said Tom Dunn, a member of Davis’ legal team.

The state attorney general’s office canceled Monday’s execution, spokesman Russ Willard said, adding that state attorneys are exploring their options.

On Wednesday, Davis’ attorneys asked the 11th Circuit for permission to pursue a new federal habeas corpus petition —- in which an inmate claims he is unlawfully incarcerated.

The Antiterrorism and Effective Death Penalty Act of 1996 requires a federal appeals court to approve such a request before a new lawsuit can be filed.

“Upon our thorough review of the record, we conclude that Davis has met the burden for a stay of execution,” the court said in an order issued by Judges Joel Dubina, Rosemary Barkett and Stanley Marcus.

The judges called the stay “conditional” and said they want to hear more from Davis’ lawyers and state attorneys. Davis must clear two difficult legal hurdles to win new appeals.

First, he must show that his lawyers could not have previously found the new evidence supporting his innocence no matter how diligently they looked for it. And he must show that the new testimony, viewed in light of all the evidence, is enough to prove “by clear and convincing evidence that … no reasonable fact finder would have found [him] guilty.”

The 11th Circuit added a twist. It asked the parties to address whether Davis can still be executed if he can establish innocence under the second standard but cannot satisfy his burden under the first, due-diligence question.

The court gave Davis’ lawyers 15 days to file their legal brief and state attorneys another 10 days to respond.

In July 2007, the state Board of Pardons and Paroles issued a stay less than 24 hours before Davis was to be put to death. Last month, the Supreme Court halted Davis’ execution with less than two hours to spare.

NEW YORK (AP)—Authorities were called to the home of former New York Knicks coach Isiah Thomas, where police said a 47-year-old man was taken to the hospital and treated for an accidental overdose of sleeping pills early Friday morning.

Police would not identify the man, except to give his age. But reached on his cell phone the 47-year-old Thomas told the New York Post he had not been treated for a sleeping pill overdose, and that it was his 17-year-old daughter Lauren who had a medical issue.

It “wasn’t an overdose,” he told the newspaper. “My daughter is very down right now. None of us are OK.”

Harrison Police Chief David Hall said the case was not a suicide attempt.

“We’re classifying it as an accidental overdose of prescription sleeping pills,” Hall said. “I’m not going to confirm or deny that it was Isiah Thomas. It was an individual at his home.”

He told The Daily News that the man took about 10 Lunesta sleeping pills. “He was unconscious, but breathing on his own,” Hall told the paper.


Thomas’ 20-year-old son Joshua also said it was his sister, not his father, who required treatment.

“He’s fine,” the Indiana University student told the Daily News. “Reports of sleeping pills are false.”

The drama is the latest in what has been a difficult year for Thomas. READ

Black turnout is strong in early voting in South

CHARLOTTE, N.C. – Blacks are already surging to the polls in parts of the South, according to initial figures from states that encourage early voting — a striking though still preliminary sign of how strongly they will turn out nationwide for Barack Obama in his campaign to become the first African-American president.
There have been predictions all year of a record black turnout for Obama. The first actual figures suggest that wasn't just talk:

• In North Carolina, blacks make up 31 percent of early voters so far, even though they're just 21 percent of the population and made up only 19 percent of state's overall 2004 vote.

• Roughly 36 percent of the early voters are black in Georgia, outpacing their 30 percent proportion of the state's population and their 25 percent share of the 2004 vote.

No one but the voters can be sure how they voted. And John McCain's campaign officials note that the Obama camp has put much more effort than they have into early voting. But the numbers are still notable.

Democrats are outvoting the GOP by a margin of 2.5-to-1 in North Carolina, where early voting has been under way for a week. That's roughly double the margin from 2004.

More than 210,000 blacks who are registered as Democrats have cast early ballots in the Tar Heel State — compared with roughly 174,000 registered Republicans overall. Four years ago, the number of GOP early and absentee voters was more than double that of black Democrats. READ

CLEVELAND – NBA superstar LeBron James and Grammy-winning recording artist Jay-Z want people to get out early to vote for Democratic presidential nominee Barack Obama.
James and Jay-Z will host a rally Wednesday at Quicken Loans Arena in Cleveland which will include a free concert by the hip-hop star.
James attended a Cleveland rally earlier this month to encourage people to vote for Obama. He's also contributed $20,000 to a committee supporting the presidential nominee.

After an extended illness, seminal comedian Rudy Ray Moore, better known as Dolemite, has died in Toledo Ohio. He was 82. According to Wikipedia, Moore is perhaps best known as Dolemite, the uniquely articulate pimp (“… rappin’ & tappin’ is my game!”) from the 1975 film “Dolemite,” and its sequel, “The Human Tornado.” The persona was developed during his earlier stand-up comedy records.

Rudy Ray Moore was also known as the “king of the party records” and released many comedy records throughout the 1960s and 1970s, developing a style even more rude and explicit than contemporaries like Redd Foxx and Richard Pryor. This kept him off of television and major films, but cultivated an enduring fan base. He also guested on Big Daddy Kane’’s CD Taste of Chocolate, released in 1990.

CLEARFIELD, Pa. – It took Brad Sciullo 4 hours and 39 minutes to finish a marathon. A meat marathon, that is. The 5-foot-11, 180-pound western Pennsylvania chef is the first person to eat a monstrosity called the Beer Barrel Belly Bruiser: a 15-pound burger with toppings and a bun that brought the total weight to 20.2 pounds.
The mountain of beef is the product of Denny's Beer Barrel Pub, about 100 miles northeast of Pittsburgh in Clearfield.
Sciullo, 21, of Uniontown, said he was surprised he finished the sandwich Monday. "About three hours into it, things got tough," he said.
When asked what possessed him to eat a burger that big, Sciullo said: "I wanted to see if I could."
The burger included a bun, lettuce, tomatoes, cheese, onions, mild banana peppers and a cup each of mayonnaise, ketchup, mustard and relish, pub owner Dennis Liegey said.
For completing the challenge in the under-five-hour time limit, Sciullo won $400, three T-shirts, a certificate "and a burger hangover, as I call it," Liegey said.

Retired General Colin L. Powell, one of the country's most respected Republicans, stunned both parties on Sunday by strongly endorsing Sen. Barack Obama (D-Ill.) for president on NBC's "Meet the Press" and laying out a blistering, detailed critique of the modern GOP.
Powell said the election of Obama would "electrify the world."
"I think he is a transformational figure," Powell said. "He is a new generation coming ... onto the world stage and on the American stage. And for that reason, I'll be voting for Senator Barack Obama."
As a key reason, Powell said: "I would have difficult with two more conservative appointments to the Supreme Court, but that's what we'd be looking at in a McCain administration."
Powell, once considered likely to be the nation's first African-American presidential nominee, said his decision was not about race.
Moderator Tom Brokaw said: "There will be some ... who will say this is an African-American, distinguished American supporting another African-American because of race."
Powell, who last year gave the Arizona senator's campaign the maximum $2,300, replied: "If I had only had that in mind, I could have done this six, eight, 10 months ago. I really have been going back and forth between somebody I have the highest respect and regard for, John McCain and somebody I was getting to know, Barack Obama. And it was only in the last couple of months that I settled on this." READ

Emory Douglas, ex Minister of Culture for the Black Panther party, will speak about the history behind the art of the party, and take a look at some more recent works.

Emory Douglas was born May 24th, 1943 in Grand Rapids, Michigan. Douglas attended City College of San Francisco where he majored in commercial art. He was politically involved as Revolutionary Artist and then Minister of Culture for the Black Panther party in Oakland, CA from February, 1967 until its discontinuance in the Early 1980’s. Douglas’s art was always seen on front pages of the Black Panther Newspaper and, reflecting the ideals and rhetoric of the Black Panther Party.

Offering a retrospective look at artwork created during in the Black Panther Party, Douglas’s work has recently been displayed at the 2008 Biennale of Sydney, the Museum of Modern Art in Los Angeles,Yerba Buena Center for the Arts, Richmond Art Center, the Station Museum of Contemporary Art. And has appeared in June/July volume of Art in America, PRINT Magazine, and the American Institute of Public Arts.

Published In 2007, Black Panther: The Revolutionary Art of Emory Douglas provides a comprehensive collection of Douglas’s work.

Upcoming exhibits include the Arts & Culture Conference of the Black Panther Party October 17-18 in Atlanta, Ga and a major exhibit of past and present work at Urbis in Manchester, England October 30th – March 2009.

High court turns down Ga. death row inmate

ATLANTA (AP) The Supreme Court has cleared the way for a Georgia man to be put to death for killing a police officer two weeks after it halted his execution to consider his appeal.

Troy Davis asked the high court to intervene in his case and order a new trial because seven of the nine witnesses against him have recanted their testimony. Former President Jimmy Carter and South Africa Archbishop Desmond Tutu are among prominent supporters who have called for a new trial.

The justices granted Davis a reprieve on Sept. 23, less than two hours before his scheduled execution. But they declined Tuesday to give his appeal a full-blown hearing. It was not immediately clear when his execution will be scheduled.

Davis' supporters, who erupted in joy when his execution was halted last month, said they were heartbroken when they received word of the decision.

"Oh, God. I think it's disgusting, terrible. I'm extremely disappointed," said Martina Correia, Davis' sister. "Well, we still have to fight. We can't stop."

Davis was convicted of the murder of 27-year-old officer Mark MacPhail, who was working off-duty as a security guard at a bus station. MacPhail's family said they were relieved.

"I was hoping that would be the decision," said MacPhail's mother, Anneliese MacPhail. "I'm hoping that soon we will have some peace, that this will all be over."

A divided Georgia Supreme Court has twice rejected Davis' request for a new trial, and had rejected his appeal to delay the execution on Monday afternoon. The Georgia Board of Pardons and Paroles also turned down his bid for clemency.

MacPhail had rushed to help a homeless man who had been pistol-whipped at a nearby parking lot, and was shot twice when he approached Davis and two other men.

Witnesses identified Davis as the shooter, and at the 1991 trial, prosecutors said he wore a "smirk on his face" as he fired the gun.

But Davis' lawyers say new evidence proves their client was a victim of mistaken identity. Besides those who have recanted their testimony, three others who did not testify have said Sylvester "Red" Coles who testified against Davis at his trial confessed to the killing.

Coles refused to talk about the case when contacted by The Associated Press during a 2007 court appearance and has no listed phone number.

Prosecutors have said the case is closed. They also say some of the witness affidavits simply repeat what a trial jury has already heard, while others are irrelevant because they come from witnesses who never testified.

CAPTAIN AMERICA IN THE LATEST HULK MOVIE

I gotta to get that hulk dvd anyway. 3 disc comes with it so so many fly joints

Captain America himself made a cameo in "The Incredible Hulk," but don't feel bad if you didn't see it. While director Louis Letterier had hinted in interviews that they had shot an appearance, the scene ended up on the cutting room floor. But now it can finally be seen in the bonus features on the DVD, as first spotted by FilmSchoolRejects.com.


In the original opening scene of the movie, Bruce Banner (Edward Norton) travels to the Arctic, away from civilization, to try to end his own life and rid the world of the Hulk. There, buried in the ice, is the frozen body of Captain America. It's a little difficult to make out the figure, but again he can be identified by his shield.

The character is scheduled to get his own film, called "The First Avenger: Captain America," in May of 2011. Then he's expected to join Iron Man, Hulk, Thor and other Marvel heroes in the group "Avengers" movie that July. The speculation is that the first movie will be his origin story, set during World War II like the initial comics. Then he will be frozen and brought back in modern times to join the team, just like he did in the books. Jon Favreau has stated he'd like to direct "The Avengers," but first he's focusing on "Iron Man 2," hitting screens in May 2010.

Officials: Financial crisis can lead to violence

An out-of-work money manager in California loses a fortune and wipes out his family in a murder-suicide. A 90-year-old Ohio widow shoots herself in the chest as authorities arrive to evict her from the modest house she called home for 38 years.

In Massachusetts, a housewife who had hidden her family's mounting financial crisis from her husband sends a note to the mortgage company warning: "By the time you foreclose on my house, I'll be dead."

Then Carlene Balderrama shot herself to death, leaving an insurance policy and a suicide note on a table.

Across the country, authorities are becoming concerned that the nation's financial woes could turn increasingly violent, and they are urging people to get help. In some places, mental-health hot lines are jammed, counseling services are in high demand and domestic-violence shelters are full.

"I've had a number of people say that this is the thing most reminiscent of 9/11 that's happened here since then," said the Rev. Canon Ann Malonee, vicar at Trinity Church in the heart of New York's financial district. "It's that sense of having the rug pulled out from under them."

With nowhere else to turn, many people are calling suicide-prevention hot lines. The Samaritans of New York have seen calls rise more than 16 percent in the past year, many of them money-related. The Switchboard of Miami has recorded more than 500 foreclosure-related calls this year.

"A lot of people are telling us they are losing everything. They're losing their homes, they're going into foreclosure, they've lost their jobs," said Virginia Cervasio, executive director of a suicide resource enter in southwest Florida's Lee County.

But tragedies keep mounting:

• In Los Angeles last week, a former money manager fatally shot his wife, three sons and his mother-in-law before killing himself.

Karthik Rajaram, 45, left a suicide note saying he was in financial trouble and contemplated killing just himself. But he said he decided to kill his entire family because that was more honorable, police said.

Rajaram once worked for a major accounting firm and for Sony Pictures, and he had been part-owner of a financial holding company. But he had been out of work for several months, police said.

After the murder-suicide, police and mental-health officials in Los Angeles took the unusual step of urging people to seek help for themselves or loved ones if they feel overwhelmed by grim financial news. They said they were specifically afraid of the "copycat phenomenon."

"This is a perfect American family behind me that has absolutely been destroyed, apparently because of a man who just got stuck in a rabbit hole, if you will, of absolute despair," Deputy Police Chief Michel Moore said. "It is critical to step up and recognize we are in some pretty troubled times."

• In Tennessee, a woman fatally shot herself last week as sheriff's deputies went to evict her from her foreclosed home.

Pamela Ross, 57, and her husband were fighting foreclosure on their home when sheriff's deputies in Sevierville came to serve an eviction notice. They were across the street when they heard a gunshot and found Ross dead from a wound to the chest. The case was even more tragic because the couple had recently been granted an extra 10 days to appeal.

• In Akron, Ohio, the 90-year-old widow who shot herself on Oct. 1 is recovering. A congressman told Addie Polk's story on the House floor before lawmakers voted to approve a $700 billion financial rescue package. Mortgage finance company Fannie Mae dropped the foreclosure, forgave her mortgage and said she could remain in the home.

• In Ocala, Fla., Roland Gore shot his wife and dog in March and then set fire to the couple's home, which had been in foreclosure, before killing himself. His case was one of several in which people killed spouses or pets, destroyed property or attacked police before taking their own lives.

"The financial stress builds up to the point the person feels they can't go on, and the person believes their family is better off dead than left without a financial support," said Kristen Rand, legislative director of the Washington D.C.-based Violence Policy Center.

Dr. Edward Charlesworth, a clinical psychologist in Houston, said the current crisis is breeding a sense of chronic anxiety among people who feel helpless and panic-stricken, as well as angry that their government has let them down.

"They feel like in this great society that we live in we should have more protection for the individuals rather than just the corporation," he said.

It's not yet clear there is a statistical link between suicides and the financial downturn since there is generally a two-year lag in national suicide figures. But historically, suicides increase in times of economic hardship. And the current financial crisis is already being called the worst since the Great Depression.

Rising mortgage defaults and falling home values are at the heart of it. More than 4 million Americans were at least one month behind on their mortgages at the end of June, according to the Mortgage Bankers Association.

A record 500,000 had entered the foreclosure process. And that trend is expected to continue through next year, despite the current programs from the government and the lending industry to refinance delinquent homeowners into more affordable loans.

Counselors at Catholic Charities USA report seeing a "significant increase" in the need for housing counseling.

One counselor said half of her clients were on some form of antidepressant or anti-anxiety medication. The agency has seen a decrease in overall funding, but it has expanded foreclosure counseling and received nearly $2 million for such services in late 2007.

Adding to financially tense households is an air of secrecy. Experts said it's common for one spouse to blame the other for their financial mess or to hide it entirely, as Balderrama did.

After falling 3 1/2 years behind in payments, the Taunton, Mass., housewife had been intercepting letters from the mortgage company and shredding them before her husband saw them. She tried to refinance but was declined.

In July, on the day the house was to be auctioned, she faxed the note to the mortgage company. Then the 52-year-old walked outside, shot her three beloved cats and then herself with her husband's rifle.

Notes left on the table revealed months of planning. She'd picked out her funeral home, laid out the insurance policy and left a note saying, "pay off the house with the insurance money."

"She put in her suicide note that it got overwhelming for her," said her husband, John Balderrama. "Apparently she didn't have anyone to talk to. She didn't come to me. I don't know why. There's gotta be some help out there for people that are hurting, (something better) than to see somebody lose a life over a stupid house."
