IN “Creator,” the rawest track on Santogold’s debut and self-titled album, the singer Santi White boasts, “Me I’m a creator/Thrill is to make it up/The rules I break got me a place up on the radar.” It’s a bohemian manifesto in a sound bite, brash and endearing, or at least it was for me until it showed up in a beer commercial. And a hair-gel commercial too.

It turns out that the insurgent, quirky rule breaker is just another shill. Billboard reported that three-quarters of Santogold’s excellent album has already been licensed for commercials, video games and soundtracks, and Ms. White herself appears in advertisements, singing for sneakers. She has clearly decided that linking her music to other, mostly mercenary agendas is her most direct avenue to that “place up on the radar.”

I know — time for me to get over it. After all, this is the reality of the 21st-century music business. Selling recordings to consumers as inexpensive artworks to be appreciated for their own sake is a much-diminished enterprise now that free copies multiply across the Web.

While people still love music enough to track it down, collect it, argue over it and judge their Facebook friends by it, many see no reason to pay for it. The emerging practical solution is to let music sell something else: a concert, a T-shirt, Web-site pop-up ads or a brand.

Musicians have to eat and want to be heard, and if that means accompanying someone else’s sales pitch or videogame, well, it’s a living. Why wait for album royalties to trickle in, if they ever do, when licensing fees arrive upfront as a lump sum? It’s one part of the system of copyright regulations that hasn’t been ravaged by digital distribution, and there’s little resistance from any quarters; Robert Plant and Alison Krauss croon for J. C. Penney and the avant-rockers Battles are heard accompanying an Australian vodka ad.

The question is: What happens to the music itself when the way to build a career shifts from recording songs that ordinary listeners want to buy to making music that marketers can use? That creates pressure, subtle but genuine, for music to recede: to embrace the element of vacancy that makes a good soundtrack so unobtrusive, to edit a lyric to be less specific or private, to leave blanks for the image or message the music now serves. Perhaps the song will still make that essential, head-turning first impression, but it won’t be as memorable or independent. READ

Santa gunman was in bitter divorce, lost job


COVINA, Calif. – A man who carried out a Christmas Eve massacre and arson dressed as Santa at the home of his former in-laws apparently intended to flee the U.S., but his plans were dashed after the inferno he created severely burned his arms and melted his red costume onto his body, police said Friday.
Bruce Jeffrey Pardo, a laid-off aerospace worker, apparently shot some of his nine victims execution-style in a plot to destroy his ex-wife's family after a costly divorce that was finalized last week. He had an airline ticket for a Christmas morning flight to Canada and $17,000 in cash on his body, some attached to his legs with plastic wrap and some in a girdle, Covina police Chief Kim Raney said. He did not know the Canadian destination.
Armed with four guns, wearing the Santa suit and carrying a fuel-spraying device wrapped like a present, Pardo showed up at the home at 11:30 p.m. Wednesday as a party of about 25 people was under way.
Raney said Pardo, 45, fired a shot into the face of an 8-year-old girl who answered the door and at first fired indiscriminately, then apparently targeted relatives of his ex-wife as other guests fled.
"There's some information that he stood over them and shot them execution-style," Raney said.
Pardo retreated to the front door and retrieved a device that mixed carbon dioxide or oxygen with high-octane racing fuel, police said. Fleeing guests saw him spraying the fuel inside the house when the vapor was ignited, possibly by a pilot light or a candle, and exploded.
"Mr. Pardo was severely injured during that explosion," Raney said. "He suffered third-degree burns on both arms and it also appears that the Santa Claus suit that he was wearing did melt onto his body."
Pardo was able to drive to his brother's home in the Sylmar area of Los Angeles, broke in and shot himself in the head. His brother discovered the body early Thursday.
Before the suicide, Pardo used remnants of the Santa suit to booby-trap his rental car to explode, the chief said.
Raney said Pardo wired the suit so when it was lifted it "would pull a trip wire or a switch, ignite a flare inside the car that would then ignite black powder and he had several hundred rounds of handgun ammunition inside the car." READ

Eartha Kitt, sultry `Santa Baby' singer, dies


NEW YORK – Eartha Kitt, a sultry singer, dancer and actress who rose from South Carolina cotton fields to become an international symbol of elegance and sensuality, has died, a family spokesman said. She was 81.
Andrew Freedman said Kitt, who was recently treated at Columbia Presbyterian Hospital, died Thursday in Connecticut of colon cancer.
Kitt, a self-proclaimed "sex kitten" famous for her catlike purr, was one of America's most versatile performers, winning two Emmys and nabbing a third nomination. She also was nominated for several Tonys and two Grammys.
Her career spanned six decades, from her start as a dancer with the famed Katherine Dunham troupe to cabarets and acting and singing on stage, in movies and on television. She persevered through an unhappy childhood as a mixed-race daughter of the South and made headlines in the 1960s for denouncing the Vietnam War during a visit to the White House.
Through the years, Kitt remained a picture of vitality and attracted fans less than half her age even as she neared 80.
When her book "Rejuvenate," a guide to staying physically fit, was published in 2001, Kitt was featured on the cover in a long, curve-hugging black dress with a figure that some 20-year-old women would envy. Kitt also wrote three autobiographies.
Once dubbed the "most exciting woman in the world" by Orson Welles, she spent much of her life single, though brief romances with the rich and famous peppered her younger years.
After becoming a hit singing "Monotonous" in the Broadway revue "New Faces of 1952," Kitt appeared in "Mrs. Patterson" in 1954-55. (Some references say she earned a Tony nomination for "Mrs. Patterson," but only winners were publicly announced at that time.) Kindly elf hands out $13,000 to LA's homeless


LOS ANGELES – While carmakers have their hands out to Congress, a kindly soul showed up in a car to deliver his own bailout to those on Skid Row.
The anonymous donor continued a holiday tradition by handing out $10 bills to people at The Midnight Mission. The shelter estimated that $13,000 was distributed this year.
"It's the highlight of my year," the donor said.
Hundreds lined up around the building Tuesday, and some said they waited as long as eight hours for the benefactor nicknamed the Eldorado Elf.
The tradition of handing out money at the mission around Christmas dates to the early 1980s when car dealer Ronald Moran began showing up in a Cadillac to pass out thousands of dollars.
When the man dubbed the Cadillac Santa died in 1992, his friend, who was the attorney for Moran's dealership, took over the handout. He showed up in a Cadillac Eldorado and thus was born the Eldorado Elf.
The elf — a 67-year-old semiretired lawyer who would only give his name as Bill — wore a bright red shirt and a smile as he and several friends distributed the money Tuesday. He said the money was needed more than ever because of the poor economy.
The donor said the money comes from himself and his friends and that he did not regret spending it even though the economy has hurt his own finances.
"Just because I've taken a hit, is that any reason that the homeless should suffer?" he said. "I've got so much more than they've got." READ

KANSAS CITY, Missouri (Reuters) – A sign outside the Shawnee Community Center states a clear goal: "A World Without Hunger." But inside, that goal is getting harder to reach.
Senior citizens, young parents and middle-aged working poor were among those lining up at the suburban center this week, quietly collecting handouts of pasta, canned vegetables, peanut butter and other staples to stave off hunger.
"We are seeing more people this Christmas than last Christmas for sure," said Shawnee Community Center volunteer Verta Morris. "A lot of people are hungry."
Long lines are common sights these days at food pantries across recession-hit America.
U.S. food banks have reported a 30 percent rise in requests for emergency food assistance, according to a report issued last week by Feeding America, which supports 63,000 agencies and is the nation's largest hunger relief organization.
The group said the situation is expected to grow worse in 2009 amid rising unemployment, and a consortium of charity groups are calling on Washington for more federal assistance. U.S. employers cut 533,000 jobs in November alone, the highest monthly number in 34 years.
"We're in a crisis. Absolutely," said Feeding America spokeswoman Maura Daly.
BREAKING POINT
Food assistance groups said many families who show up at their doors were recently making it on their own. But two years of rising food and energy costs ate into what little safety net those families had. Now, as jobs losses rise, many who were making ends meet can no longer do so.
"People have just been stretched to the breaking point. They have to turn to someone for help," said Karen Siebert, spokeswoman for Harvesters Community Food Network in Kansas City, which provides food for 420 food pantries in a 13-county area and has seen demand jumped 50 percent this year.
Debbie and Victor Turner, both 48, were among many waiting their turn on Monday in Shawnee for food supplies, which this week included a frozen turkey as a holiday treat.
Victor once worked in construction but he and his wife now clean houses for $65 to $100 a house. They collect and sell scrap metal to cover their rent and care for three grandchildren. READ

NEW BEDFORD, Mass. (AP) — Fire officials in New Bedford, Mass., say a man using a blowtorch to melt ice on his back porch ended up setting his house on fire, causing up to $30,000 in damage.
Fire Capt. Scott Kruger tells The Standard-Times of New Bedford that no on was injured during Monday's incident at the three-story home.
Kruger says the man was using a torch hooked up to a 20-pound propane cylinder. He got too close to the building's wood frame and ignited the vinyl siding. The fire quickly spread into the building's second- and third-floor apartments.
It took 25 firefighters to subdue the blaze that damaged bedrooms in the upstairs units, and caused damage to the structure and wiring.
The homeowner will not be charged.

PACQUIAO PUTS IT ON DE LA HOYA


Manny Pacquiao confirmed his status as the world's best pound-for-pound boxer last night with a stunning, lop-sided victory in Las Vegas over Oscar De La Hoya, one that - if sense prevails - will send boxing's "golden boy" into retirement and propel Ricky Hatton towards the most sustained and serious preparation of his career. The Manchester boxer is hoping to fight the Filipino in England next May, probably at Wembley. He had better be more than ready.

Lighter, shorter and less illustrious, Pacquiao was billed as De La Hoya's inferior in multiple ways but when the boxing started he was so superior that this hugely anticipated contest rapidly developed into a ritual humiliation. The official verdict was a technical knock-out at the end of the eighth round but truth was that De La Hoya quit on his stool – whether at the behest of his corner or of his own volition wasn't immediately clear, although in the greater scheme of things such detail scarcely mattered. The 35-year-old began the night as the odds-on favourite and ended it in a Las Vegas hospital, where he underwent precautionary checks.

Two of the three judges scored all eight rounds for Pacquiao, while a third gave the opening round to the American – an assessment that was not so much a mistake as a case for the ringside doctor. "I just don't have it anymore,'' the loser, a world champion in six weight divisions, said afterwards.

No one inside the MGM's Grand Garden Theatre had any reason to disagree with that, although in fairness to De La Hoya it was hard to believe anyone – not even De La Hoya in his prime – could have prevailed in the face of Pacquiao's speed and ringcraft.

The tone was set from the opening bell, with the Filipino landing a couple of early combinations, both unanswered, and a series of jabs. They didn't appear to seriously hurt his opponent but they established that his disadvantages in height and reach were destined to be of little consequence.

By contrast, De La Hoya barely landed a punch, never mind a punch of any consequence, in the opening exchanges and was reduced to the pawing aimlessly in the direction of his elusive opponent, like a late night reveller in search of the bedroom light switch.

The second round was no less one-sided, along with the third and fourth rounds, by which time De La Hoya's face was badly marked and Pacquiao's confidence so heightened that he could afford to mock his opponent on the (rare) occasions where he was actually able to land a blow.

De La Hoya retained a puncher's chance of snatching a victory, but even that hope was extinguished when he landed a solid upper-cut in the sixth round only to see his opponent shrug it off and press on ahead. Pacquiao's sustained attacks in the seventh and eighth left the American staggering, held upright only by his own courage. But even that had its limit.

"We knew we had him after the first round," Pacquiao's trainer, Freddie Roach said. "He had no legs, he was hesitant and he was shot. He is a great fighter, I love him, but I hope this is last fight and that he will retire."

If De La Hoya's career is over, it will be the end of a remarkable story that began when he won the Olympic gold medal in Barcelona in 1992 and went on to become the biggest box office attraction in the sport. "My heart still wants to fight, that's for sure," De La Hoya said. "But when your physical doesn't respond, what can you do? I have to be smart and make sure I think about my future plans."

Week Ending Nov. 30, 2008: West's Numbers Head South

Dude ain't even sweating the sales

Kanye West's fourth album, 808s & Heartbreak, debuts at #1 with first-week sales of 450,000. That's less than half of what West's last album, Graduation, sold in its first week in September 2007. Graduation sold 957,000 copies out-of-the-shoot, boosted by West's high-profile face-off with rival 50 Cent and by a monster single, "Stronger," which hit #1 on the Hot 100 the same week the album debuted at #1. West's second album, Late Registration, opened with sales of 860,000 in September 2005, boosted by similar factors. West had stirred national controversy on Sept. 2 with explosive comments ("George Bush doesn't care about black people") during a post-Katrina telethon on NBC-TV. Also, his single "Gold Digger" hit #1 on the Hot 100 the week the album topped the chart.
West hasn't picked a fight with anybody lately, and his recent singles, while successful, haven't reached #1 on the Hot 100. "Love Lockdown" has climbed as high as #3; "Heartless" has reached #4.

The fall-off can't be attributed solely to an industry slump. West's first-week number is down in both absolute and relative terms. Late Registration debuted with the second-biggest weekly sales total of 2005, topped only by 50 Cent's The Massacre. Graduation opened with the biggest weekly total of 2007. But 808s and Heartbreak is only the 10th biggest weekly sales total so far in 2008.

There is, of course, another factor that I haven't really addressed in this space yet. The nation's economy went off a cliff in September (perhaps you heard). People are being far more cautious in their discretionary spending. That's bound to make people think twice about whether they really need the new album by Kenny Chesney or Beyonce, to name two other artists who have debuted at #1 in recent weeks with smaller first-week totals than they achieved last time out.

All four of West's albums have started with sales north of 400,000 units. West's debut album, The College Dropout, debuted at #2 in February 2004, with first-week sales of 441,000. To have four consecutive albums start with sales of 400K or more over a nearly five year span is nothing to sneeze at.

The title, 808s & Heartbreak, refers to the album's split focus. West constructed some of the tracks on a Roland TR-808 drum machine. The other tracks reflect recent losses-a breakup with his fiancé and his mother's death. Rolling Stone's Jody Rosen likens the album to two other famous breakup albums--Bob Dylan's Blood On The Tracks, which topped the chart in 1975, and Marvin Gaye's Here, My Dear, a Top 30 album in 1979.

Nearly one-quarter of West's first-week sales total came in the digital realm. The album sold 103,000 downloads. That's the second biggest first-week digital tally ever for a rap or hip-hop album. Only Graduation surpasses it, with first-week digital sales of 133,000. Lil Wayne's Tha Carter III is third with first-week digital sales of 100,000.

With everything 1980's being either made, remade, or re-imagined, one of our favorite readers and insiders who we haven't heard from in a hot minute, EL CHAVO has the goods on Eddie Murphy's 80's update of Beverly Hills Cop 4. Written by Michael Brandt and Derek Haas, to be directed by Brett Ratner and produced by Lorenzo "Action Man" DiBonaventura (taking over for Jerry Bruckheimer), Beverly Hills Cop IV is slated to be released in 2010.

Here is the scoop: The studio loves the draft but Eddie Murphy is not too keen on it.

Released in 1984, the original “Beverly Hills Cop” grossed $316 million worldwide and spawned two sequels. All told, the three pics grossed $712.9 million worldwide. The last was released in 1994.

We are working on scoring details for other 1980's sequels and remakes. In the meantime, El Chavo chimes in with his thoughts below...

It's been 15 years since Axel Foley was last in Beverly Hills, and screenwriters Michael Brandt and Derek Haas needed a good reason to bring him back. That reason comes just a couple of pages into the latest script for Beverly Hills Cop IV (which calls itself Beverly Hills Cop 2009) - Judge Reinhold's Billy Rosewood takes a leap out the 20th story of the Los Angeles Police HQ.
