700 NYC teachers are paid to do nothing

NEW YORK – Hundreds of New York City public school teachers accused of offenses ranging from insubordination to sexual misconduct are being paid their full salaries to sit around all day playing Scrabble, surfing the Internet or just staring at the wall, if that's what they want to do.

Because their union contract makes it extremely difficult to fire them, the teachers have been banished by the school system to its "rubber rooms" — off-campus office space where they wait months, even years, for their disciplinary hearings.
The 700 or so teachers can practice yoga, work on their novels, paint portraits of their colleagues — pretty much anything but school work. They have summer vacation just like their classroom colleagues and enjoy weekends and holidays through the school year.

"You just basically sit there for eight hours," said Orlando Ramos, who spent seven months in a rubber room, officially known as a temporary reassignment center, in 2004-05. "I saw several near-fights. `This is my seat.' `I've been sitting here for six months.' That sort of thing."

Ramos was an assistant principal in East Harlem when he was accused of lying at a hearing on whether to suspend a student.

Ramos denied the allegation but quit before his case was resolved and took a job in California.

Because the teachers collect their full salaries of $70,000 or more, the city Department of Education estimates the practice costs the taxpayers $65 million a year. The department blames union rules.
"It is extremely difficult to fire a tenured teacher because of the protections afforded to them in their contract," spokeswoman Ann Forte said.

City officials said that they make teachers report to a rubber room instead of sending they home because the union contract requires that they be allowed to continue in their jobs in some fashion while their cases are being heard. The contract does not permit them to be given other work.

Ron Davis, a spokesman for the United Federation of Teachers, said the union and the Department of Education reached an agreement last year to try to reduce the amount of time educators spend in reassignment centers, but progress has been slow.

"No one wants teachers who don't belong in the classroom. However, we cannot neglect the teachers' rights to due process," Davis said. The union represents more than 228,000 employees, including nearly 90,000 teachers.

Many teachers say they are being punished because they ran afoul of a vindictive boss or because they blew the whistle when somebody fudged test scores.

"The principal wants you out, you're gone," said Michael Thomas, a high school math teacher who has been in a reassignment center for 14 months after accusing an assistant principal of tinkering with test results.

City education officials deny teachers are unfairly targeted but say there has been an effort under Mayor Michael Bloomberg to get incompetents out of the classroom. "There's been a push to report anything that you see wrong," Forte said.

Some other school systems likewise pay teachers to do nothing.

The Los Angeles district, the nation's second-largest school system with 620,000 students, behind New York's 1.1 million, said it has 178 teachers and other staff members who are being "housed" while they wait for misconduct charges to be resolved.
Similarly, Mimi Shapiro, who is now retired, said she was assigned to sit in what Philadelphia calls a "cluster office." "They just sit you in a room in a hard chair," she said, "and you just sit."

Teacher advocates say New York's rubber rooms are more extensive than anything that exists elsewhere.

Teachers awaiting disciplinary hearings around the nation typically are sent home, with or without pay, Karen Horwitz, a former Chicago-area teacher who founded the National Association for the Prevention of Teacher Abuse. Some districts find non-classroom work — office duties, for example — for teachers accused of misconduct.

New York City's reassignment centers have existed since the late 1990s, Forte said. But the number of employees assigned to them has ballooned since Bloomberg won more control over the schools in 2002. Most of those sent to rubber rooms are

teachers; others are assistant principals, social workers, psychologists and secretaries.

Once their hearings are over, they are either sent back to the classroom or fired. But because their cases are heard by 23 arbitrators who work only five days a month, stints of two or three years in a rubber room are common, and some teachers have been there for five or six.

The nickname refers to the padded cells of old insane asylums. Some teachers say that is fitting, since some of the inhabitants are unstable and don't belong in the classroom. They add that being in a rubber room itself is bad for your mental health.

"Most people in that room are depressed," said Jennifer Saunders, a high school teacher who was in a reassignment center from 2005 to 2008. Saunders said she was charged with petty infractions in an effort to get rid of her: "I was charged with having a student sit in my class with a hat on, singing."

The rubber rooms are monitored, some more strictly than others, teachers said.

"There was a bar across the street," Saunders said. "Teachers would sneak out and hang out there for hours."
Judith Cohen, an art teacher who has been in a rubber room near Madison Square Garden for three years, said she passes the time by painting watercolors of her fellow detainees.

"The day just seemed to crawl by until I started painting," Cohen said, adding that others read, play dominoes or sleep. Cohen said she was charged with using abusive language when a girl cut her with scissors.
Some sell real estate, earn graduate degrees or teach each other yoga and tai chi.

David Suker, who has been in a Brooklyn reassignment center for three months, said he has used the time to plan summer trips to Alaska, Cape Cod and Costa Rica. Suker said he was falsely accused of throwing a girl's test sign-up form in the garbage during an argument.

"It's sort of peaceful knowing that you're going to work to do nothing," he said.

Philip Nobile is a journalist who has written for New York Magazine and the Village Voice and is known for his scathing criticism of public figures. A teacher at Brooklyn's Cobble Hill School of American Studies, Nobile was assigned to a rubber room in 2007, "supposedly for pushing a boy while I was breaking up a fight." He contends the school system is retaliating against him for exposing wrongdoing.

He is spending his time working on his case and writing magazine articles and a novel.

"This is what happens to political prisoners throughout history," he said, alluding to the Rev. Martin Luther King Jr. "They put us in prison and we write our `Letter From the Birmingham Jail.'"

Restaurants Are Piling on Fat, Calories With Larger Portions, Group Says

Restaurants are serving ever-larger portions of super-bad food to entice customers to start eating out again, according to a consumer watchdog group.

In a list of the most over-the-top, unhealthy restaurant foods, the Center for Science in the Public Interest singled out some dishes that provide more saturated fat or sodium than most people should eat in three days. The foods were also high in calories.

U.S. dietary guidelines call for healthy Americans to get less than 2,300 milligrams of sodium a day, about the amount in a teaspoon of table salt, to lower blood pressure and reduce risk of heart disease, stroke, heart failure, and kidney disease. But for the 70% of Americans who are middle-aged or older, African-American, or have high blood pressure, no more than 1,500 milligrams a day is recommended.

Federal nutrition guidelines also advise that less than 10% of daily calories come from saturated fat, about 20 grams for a 2,000-calorie diet. Eating lots of saturated fat can lead to increased risk of cardiovascular disease.

The group’s Xtreme Eating 2009 dishes, listed in the June issue of its Nutrition Action Healthletter, include:

Chili’s Big Mouth Bites with French fries (four mini bacon cheeseburgers with fried onion strings): 2,350 calories, 38 grams saturated fat, 3,940 milligrams sodium.

Olive Garden Tour of Italy, with lasagna, chicken parmigiana, and fettuccine alfredo: 1,450 calories, 33 grams saturated fat, 3,830 milligrams sodium.

The Cheesecake Factory Fried Macaroni and Cheese: 1,570 calories, 69 grams saturated fat, 1,860 milligrams sodium.

Chili’s Original Half Rack of Baby Back Ribs: An add-on for entrees, with 490 calories, 12 grams saturated fat, and 2,050 milligrams sodium.

Red Lobster Ultimate Fondue shrimp and crabmeat in a lobster cheese sauce served in a sourdough bread bowl: 1,490 calories, 40 grams saturated fat, 3,580 milligrams sodium.

Uno Chicago Grill’s Mega-Sized Deep Dish Sundae: 2,800 calories, 72 grams saturated fat.

The Cheesecake Factory’s Chicken and Biscuits: 2,500 calories.

Applebee’s Quesadilla Burgerwith fries: 1,820 calories, 46 grams saturated fat, 4,410 milligrams sodium.

The Cheesecake Factory Philly Style Flat Iron Steak with fries: 2,320 calories, 47 grams saturated fat, 5,340 milligrams sodium.

The examples are extreme, says Jayne Hurley, RD, chief nutritionist for the Center for Science in the Public Interest. But that’s the point.

“The problem is these oversized foods come with oversized calories, saturated fat, and sodium,” Hurley says. “It used to be you got a single entree, and now in some cases you’re getting three entrees on your plate.”

The typical restaurant entree, appetizer, and dessert contain about 1,000 calories apiece, Hurley says. The Center for Science in the Public Interest obtained the nutritional information in the report from restaurant web sites and menus.

“As a consumer-driven industry, we give our guests what they want,” says Shelia Weiss, RD, a nutrition consultant for the National Restaurant Association, an industry trade group. “Certainly there are indulgent items on menus, but there are more diet-conscious items on menus than ever before.”

Hurley believes diners don’t realize just how indulgent some items are. It’s a given that you’re splurging when you order Uno Chicago Grill’s Mega-Sized Deep Dish Sundae, a chocolate-chip cookie baked in a pizza pan and topped with ice cream, whipped cream, and chocolate sauce, she says.

“But how many people would guess there are 2,800 calories and 72 grams of saturated fat when that sundae hits the table?”

Weiss disputes CSPI’s contention that restaurants may be offering much larger portions to entice recession-weary customers into eating out again.

“If anything, restaurants are adjusting their portion sizes down as a measure of the economy,” Weiss says.

The Center for Science in the Public Interest is backing a federal menu labeling bill that would require calorie counts to be listed on the menus and menu boards of chain restaurants. The National Restaurant Association is supporting a measure that would allow nutritional information to be listed in other locations -- such as a brochure or poster -- when a customer orders.

Providing more information on fat, calories, and sodium in restaurant meals would help diners trying to protect their health, says Dawn Jackson Blatner, RD, a spokeswoman for the American Dietetic Association. Blatner, who provides nutrition counseling, says helping her clients learn what’s in restaurant meals is critical.

“People do not understand just how high in fat and calories these things can range,” Blatner says. “We’re talking about a day’s worth of calories in some cases. And, this is not the only meal that most people are going to be eating in a day. It’s no surprise that two out of three people are overweight in America.”

Want to avoid restaurant meals high in fat, calories, and sodium? Try these tips:

Check online for nutritional information before dining out. If your restaurant doesn’t disclose information, look for similar dishes at other restaurants that do provide that data.
Downsize the portion. Order a lunch portion or half-portion. Split a dish with a friend. Or take half home to eat later.
Try customizing. Ask if a food can be baked or grilled instead of fried. Substitute a vegetable for a side dish that may be high in calories and fat, such as a biscuit or mashed potatoes. If a food is laden with fatty additions, such as bacon, mayonnaise, and cheese, ask for it to be prepared without at least one of those high-fat foods.

More than 2 million households are in danger of seeing their major broadcast TV channels disappear into a fuzz of static when analog service ends Friday, according to surveys.

That is nearly half the number that were unready in February, when most analog TV broadcasts were originally scheduled to be turned off. The shutdown was delayed for four months at the behest of the Obama administration.

Research firm SmithGeiger LLC said Thursday that about 2.2 million households were still unprepared around the beginning of June. Sponsored by the National Association of Broadcasters, it surveyed 948 households that relied on antennas and found that 1 in 8 had not connected a digital TV or digital converter box.

Nielsen Co., which measures TV ratings with the help of a wide panel of households, put the number of unready homes at 2.8 million, or 2.5 percent of the total television market, as of Sunday. In February, the number was 5.8 million.

"We know some viewers will wait until the very last minute, or even after June 12, until they take action," said Paul Karpowicz, second vice chair of the television board of the NAB.

Requests for $40 converter box coupons from the government have spiked this week, according the to the Department of Commerce. On Monday alone, it received requests for 179,000 coupons, nearly twice the daily rate it saw a month ago. However, those coupons won't get to viewers by Friday. It takes nine business days. Without the government discount, converter boxes generally cost between $40 and $60.

Nielsen said minority households are less likely to be prepared, as are households consisting of people under age 35. Households with people older than 55 are far more likely to be prepared than the average.

The Albuquerque-Santa Fe area continues to be the nation's least ready market in the Nielsen survey, with 7.6 percent of TV households still unprepared.

Nielsen does not survey Puerto Rico, which is also believed to have many unready households. Both the Caribbean island and New Mexico have relatively few households connected to cable. Households that have all their sets connected to cable or satellite service are unaffected by the analog broadcast shutdown.

Both the Nielsen and SmithGeiger surveys count households as unprepared even if they have taken some steps toward getting digital signals, like ordering a converter box coupon.

Stations will start cutting their analog signals Friday morning, but many will wait until the evening. Nearly half of all U.S. stations have already ended analog transmissions, though most big-city stations have held off until Friday.

A New CD That Has No Music, but Lots of Pictures

Remember when Mos def came out with just the cd in the plastic case with no cover because of the situation with his record label. Dj Danger mouse takes it to the next level. Pretty gangsta. hahahahaha. Poor record label

From the start, there was something mysterious about Danger Mouse’s latest project, “Dark Night of the Soul.”

Word of it first came at the South by Southwest music festival in March, on a poster that simply listed the name Danger Mouse — the record producer and member of the R&B duo Gnarls Barkley — along with the singer-songwriter Sparklehorse and, among others, the director David Lynch. A YouTube video in Mr. Lynch’s unmistakable style stirred interest but added no details.

It was classic teaser marketing. And yet when “Dark Night of the Soul” was finally unveiled a few weeks ago, it still left fans puzzled. The project, it turned out, is a large-format book-and-CD package that Danger Mouse was releasing by himself, with 50 photographs by Mr. Lynch intended as accompaniment to the album’s 13 songs. But the CD is blank and recordable, and a sticker on the shrink wrap explains cryptically: “For legal reasons, enclosed CD-R contains no music. Use it as you will.”

Bloggers and journalists speculated widely about why Danger Mouse, whose real name is Brian Burton, had withdrawn the music from the book. A statement on the project’s Web site (dnots.com) blamed “an ongoing dispute with EMI.”

In response, EMI issued a statement that offered no greater clarity but hinted at a negotiation: “Danger Mouse is a brilliant, talented artist for whom we have enormous respect. We continue to make every effort to resolve this situation and we are talking to Brian directly. Meanwhile, we need to reserve our rights.”

In most cases this turn of events would signify defeat: an artist battles a record label, and his music vanishes down the memory hole. But in the peculiar way that Danger Mouse has built his career, “Dark Night of the Soul” seemed to be an oblique victory, in which failure at official business can generate notoriety and, ultimately, lead to success in other endeavors.

Controversial at best, Fokof as it is affectionately known, is one of South Africa’s most watched groups. The media love the band member’s brash attitudes, the fans love the angst filled music and punk rock attitude whilst the conservative minority fear the band’s power to change years of religious and authoritarian indoctrination. It’s ability to turn any show into all out chaos has made the band one of the most popular live acts in South African music history. Box Office Wrapup: The Hangover edges out Up for top spot

It looks like The Hangover actually ended up edging out Up for the top spot at the box office this weekend! Contrary to previous estimates, the box office actuals reveal that The Hangover brought in just under $45 million while Pixar's Up raked in just over $44 million in its second week of release. Estimates had Up at $44.2 million and The Hangover at $43.3 million. Will Ferrell's latest, Land of the Lost also came in a little lower than the weekend estimates predicted, earning $18.8 million, but the rest of the top 12 were fairly accurate. It's not often that a movie will take the box office crown on the last day, but it was very close this weekend between the top two, and it made for an exciting race.

Freedom or Everybody Dies is a 5-minute mixed media short that blends photography, video and music to tell the real story of hip-hop’s present generation. Focusing on the subculture that takes place in many of America’s inner cities, Freedom or Everybody Dies is comprised of 500 still photos and 3 minutes of video footage synchronized to a score that highlights the intensity of the images.

Shot in and around the now defunct Arcadian Gardens, a subsidized housing project in East Orange, New Jersey, the short film gives a glimpse into the lives of the children and young adults who lived there. With B.L.O.O.D. red as the backdrop, director Akintola Hanif | Hyze, presents a very real image of the gang presence and culture within “The Bity”, as Arcadian Gardens is known to it’s former residents.

You may have more Facebook friends as the years go by, but when it comes to your close friends, you lose about half and replace them with new ones after about seven years, new social research suggests.
As a result, the size of your social network stays about the same.
People might like to think they have control over whom they choose as friends, but social networks could also be influenced by the context in which we meet one another. Sociologist Gerald Mollenhorst of Utrecht University in the Netherlands was interested in finding out exactly how much our networks are shaped by social context or by personal preference.

He conducted a survey of 1,007 people ages 18 to 65, and then contacted the participants seven years later. From the original group, 604 people were re-interviewed. The survey contained questions such as: Who do you talk with, regarding personal issues? Who helps you with DIY in your home? Who do you pop by to see? Where did you get to know that person? And where do you meet that person now?

The results showed that personal network sizes remained stable, but that many members of the network were new. About 30 percent of discussion partners and practical helpers had the same position in a typical subject's network seven years later. And only 48 percent were still part of the network. This finding goes against previous research which had showed that social network sizes are shrinking.

Mollenhorst also established that networks were not formed based on personal choices alone. Our friend choices are limited by the opportunities to meet. He saw that people frequently choose friends from a context in which they have previously chosen a friend. Also, whether or not our friends know each other strongly depends on the context under which people meet.

Mollenhorst's research is part of the project "Where friends are made. Context, Contacts, Consequences," set up by Beate Völker.
